Terms of Service for WorksheetPal

1. Acceptance of Terms

Welcome to WorksheetPal! These Terms of Service ("Terms") govern your access to and use of worksheetpal.com (the "Site") and our educational services (the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

For Parents/Guardians: By creating an account, you represent that you are at least 18 years old and have authority to bind yourself and any child you register to these Terms.

For Children: Our Services are intended for children under 13 with parental supervision. Children should only use WorksheetPal with parent/guardian approval and oversight.

2. Description of Services

WorksheetPal provides:

Interactive educational worksheets for grades 1-6
Subjects: Math, Science, Geography, English
Subject-categorized mini-games (Geography, Math, Science, and English)
AI-powered content generation and learning assistance (Smarky)
Text-to-speech narration of worksheet and game content
Progress tracking and gamification features, including an optional public leaderboard (see Section 9)
PDF worksheet downloads
Subscription-based access to premium features

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Account Registration and Security

Account Creation

Accounts must be created by parents or legal guardians
You must provide accurate, current, and complete information
You are responsible for maintaining account confidentiality
One account per family/household
A parent account may explore eligible unpersonalized games, worksheets, and freemium content without creating a kid profile
General exploration does not require a child's name, grade, birthday, country, learning difficulties, or learning topics
A kid profile is required for saved child-specific progress, recommendations, assessments, points, and other personalization
Before a kid profile can be created or restored, the parent must complete the separate parental-consent verification described in Section 9

Account Security

Keep your password secure and confidential
Notify us immediately of unauthorized access
You are responsible for all activities under your account
Do not share accounts with others outside your household

Account Termination

You may delete your account at any time in Account Settings
We may suspend or terminate accounts for Terms violations
Upon termination, access to paid features ends immediately
Account deletion cancels any active subscription immediately and does not automatically issue a refund
If you want us to review a refund request, contact [email protected] before deleting your account

Billing Terms

Subscriptions billed monthly in advance, or annually in advance where an annual option is offered (at a discounted effective rate)
Automatic renewal unless canceled — monthly plans renew monthly, annual plans renew annually
Payments processed securely through Stripe
You authorize recurring charges to your payment method for your selected billing cycle
Price changes communicated 30 days in advance

Cancellation and Refunds

Cancel anytime in Account Settings
Cancellation effective at end of current billing period
No partial refunds for unused time
Free trial cancellations (if offered) result in immediate loss of access
Refunds considered on case-by-case basis for service issues
Account deletion is different from ordinary subscription cancellation: it ends access and cancels the subscription immediately
Refund requests related to account deletion must be submitted to [email protected] before the account is deleted and are reviewed individually; a refund is not guaranteed
Accounts that have used a referral reward, referral credit, promotional discount, coupon, or similar benefit are not eligible for an account-deletion refund, except where applicable law requires otherwise
For annual subscriptions and other long-term prepaid plans, we may review the unused subscription term and determine whether a full, partial, or no refund is appropriate, subject to applicable law

Failed Payments

We will attempt to charge failed payments up to 3 times
Account downgraded to Free after failed payment
No access to paid features until payment resolved

5. Acceptable Use Policy

You MAY:

Use Services for personal, non-commercial educational purposes
Download worksheets for your registered child's use
Print worksheets for offline completion
Share progress with teachers (at your discretion)

You MAY NOT:

Share, resell, or redistribute worksheets
Create multiple accounts to circumvent download limits
Use automated tools to scrape or download content in bulk
Reverse engineer or attempt to extract source code
Upload malicious code or interfere with Services
Impersonate others or provide false information
Use Services for any illegal purpose
Remove copyright notices or branding from worksheets

Consequences of Violations

Warning for first minor violation
Account suspension for repeated violations
Permanent ban and legal action for severe violations

6. Intellectual Property Rights

Our Content

All worksheets, exercises, graphics, text, software, and Smarky character are owned by WorksheetPal or licensors
Protected by copyright, trademark, and other intellectual property laws
You receive a limited, non-exclusive, non-transferable license to use Services

Your License

Personal, educational use only
Cannot modify, distribute, or create derivative works
Cannot use for commercial purposes or resale
License terminates when account is closed or Terms violated

User Content

You retain ownership of user-generated content (exercise responses)
You grant us license to use, store, and display this content to provide Services
We may use aggregate, anonymized data for service improvement

Trademarks

"WorksheetPal," "Smarky," and our logos are trademarks
Cannot be used without written permission

7. AI-Generated Content and Accuracy

Content Generation

Worksheets generated primarily using Google Gemini AI technology, with other AI models used as fallbacks to maintain service availability
We strive for accuracy but cannot guarantee error-free content
Content reviewed for age-appropriateness and educational value
Not a substitute for professional educational assessment

AI-Generated Images

Illustrative worksheets use AI image-generation models (including Google Imagen, GPT-Image, and Google Gemini's image model)
These images are original AI outputs, not verbatim reproductions of any source or reference image
AI-generated images are licensed to you for personal, educational use only and are not licensed for commercial redistribution

Smarky AI Assistant

Provides hints and educational guidance, not direct answers
Responses generated by AI may occasionally be imperfect
Intended to supplement, not replace, parent/teacher guidance
Parents should monitor children's interactions with AI assistant

Disclaimer

We make reasonable efforts to ensure content quality but:

Cannot guarantee all content is 100% accurate
Are not liable for educational outcomes
Recommend parental review of all content
Welcome feedback on content issues

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains:

What information we collect
How we use and protect information
Your rights under COPPA and GDPR
How to access, update, or delete data

Your GDPR Rights: If you are located in the European Economic Area or another jurisdiction covered by GDPR, you have the right to access, rectify, erase, restrict or object to the processing of, and receive a portable copy of, your personal data. Contact [email protected] to exercise these rights.

Cookies: We use cookies and similar technologies as described in our Cookie Policy, presented to you via a cookie consent banner on your first visit. You can review or change your preferences at any time through that banner.

By using our Services, you consent to data practices described in our Privacy Policy.

9. Children's Privacy (COPPA Compliance)

Parental Consent

WorksheetPal enforces a backend requirement for current verifiable parental consent before kid-profile creation or restoration and persistent child-specific personalization
A qualifying Stripe transaction may be satisfied by a subscription purchase or by the disclosed, automatically refunded EUR €0.50 verification payment. The verification payment does not purchase a subscription or unlock premium features
Premium personalised entitlements require an eligible paid subscription in addition to active parental consent and a kid profile
Payment, saving a card, Terms acceptance, a checkbox, and ordinary account-email verification do not independently constitute parental consent
Parents control all account settings and data
Parents can review, modify, or delete child's information

If consent is missing, expired, or withdrawn, covered personalised processing is paused. Existing kid profiles are preserved for parent-controlled review, export, or deletion unless the parent deletes them or the applicable retention policy requires another action.

Information Collection

We collect minimal information from children (first name, grade, progress, and their answers/interactions within worksheets and games)
Worksheet and game text may be converted to spoken audio using text-to-speech technology; see Section 12 for details on how this and other AI processing handles children's interaction data
No behavioral advertising to children
No sharing of children's data with third parties for marketing

Leaderboard Visibility

Some games include a public leaderboard displaying a stable fictional nickname and score by default
A parent may separately enable disclosure of the kid-profile name and country. These are independent choices and can be disabled again in the Kids Profiles settings
Email addresses are never displayed. When country disclosure is disabled, the flag is replaced by a privacy indicator

Parental Rights

Parents may:

Review all collected information
Request deletion of child's data
Refuse further data collection
Opt their child out of leaderboard participation
Contact us at [email protected]

10. Disclaimers and Limitation of Liability

Service "As Is"

SERVICES PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

Warranties of merchantability or fitness for particular purpose
Guarantees of educational outcomes or improvement
Uninterrupted or error-free service
Security of data transmission

Educational Disclaimer

WorksheetPal is supplemental educational tool, not comprehensive curriculum
Not substitute for qualified teachers or tutors
Does not diagnose learning disabilities or provide medical advice
Parents responsible for monitoring children's education

Limitation of Liability

TO MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for indirect, incidental, or consequential damages
Total liability limited to amount paid in past 12 months (maximum $120)
Not liable for third-party actions or content
Not liable for data loss, service interruptions, or technical issues

Exceptions

Some jurisdictions don't allow liability limitations. In such cases, liability limited to fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold WorksheetPal harmless from:

Your violations of these Terms
Your misuse of Services
Infringement of third-party rights
Any content you submit

We reserve the right to assume exclusive defense and control of any matter subject to indemnification.

12. Third-Party Services

Integrated Services

We use the following third-party services to operate WorksheetPal:

AI content and image generation

Google Gemini: Primary AI content generation, illustrative-worksheet colorization, and our WhatsApp chatbot
OpenAI: Fallback AI content generation when Gemini is unavailable
Anthropic (Claude): Powers select internal admin-assistant tools; does not process content on behalf of child or parent accounts
Google Imagen, GPT-Image, and Replicate: Generate illustrative worksheet images

Voice and messaging

Google Cloud Text-to-Speech: Converts worksheet and game text into spoken audio
Meta / WhatsApp Cloud API: Powers our optional WhatsApp chatbot (see below)

Infrastructure, payments, and operations

Supabase: Hosts our database, authentication, and file storage
Stripe: Payment processing for subscriptions
Resend: Delivery of transactional and, where applicable, promotional email
Sentry: Error monitoring and crash reporting
Microsoft Clarity: Consent-based heatmaps and session recordings limited to specifically designated campaign landing pages directed to parents; signup forms are masked and Clarity tracking is disabled in child-facing or signed-in learning areas

These services have their own terms and privacy policies. We are not responsible for third-party practices.

What We Do — and Do Not — Share With These Services

When a child interacts with worksheets, games, Smarky, or text-to-speech narration, the applicable AI content, image, and voice providers listed above (Google Gemini, OpenAI, Google Imagen, GPT-Image, Replicate, and Google Cloud Text-to-Speech) receive only the context needed for the requested function:

The interaction data needed to generate a response — a child's typed or selected answers, and the worksheet/game text to be narrated
A non-identifying learning profile — grade level, subject/topic, areas of difficulty, and stated learning preferences

We do not intentionally send a child's name, email address, country, precise location, or parent-account identifier to these educational AI providers. WorksheetPal personalises returned copy, including inserting a kid-profile name where appropriate, after the provider response is received.

This is distinct from our payment, hosting, and communication providers (Stripe, Supabase, Resend, Meta/WhatsApp), which necessarily process some account-identifying information — such as a parent/guardian's email address or payment details — because that information is required for them to perform their specific function (processing a payment, hosting your account and data, delivering an email, or delivering a WhatsApp message you initiated). We do not sell or share this information for advertising purposes.

WhatsApp Chatbot

If you choose to interact with WorksheetPal through WhatsApp:

Messages you send are processed by Meta's WhatsApp Cloud API and by Google Gemini to generate responses
The chatbot is an automated AI assistant, not a human representative
Avoid sharing sensitive personal information over WhatsApp beyond what's needed to use the chatbot

Parent Campaign Analytics

On specifically designated campaign landing pages directed to parents, visitors who accept analytics cookies may have clicks, taps, scrolling, and rendered-page interactions recorded by Microsoft Clarity to help us improve campaign usability and conversion. We mask the signup area, do not send account identifiers to Clarity, and disable Clarity tracking on child-facing, authenticated, game, worksheet, or learning routes. Visitors can reject or withdraw analytics consent through the cookie-preference controls.

Services may contain links to third-party websites. We do not endorse or control external sites and are not responsible for their content or practices.

13. Dispute Resolution

Governing Law

These Terms governed by laws of [Your State/Country], without regard to conflict of law provisions.

Informal Resolution

Before legal action, contact us at [email protected] to resolve disputes informally. We will work in good faith to reach resolution.

Arbitration (Optional - Consult Lawyer)

Any disputes resolved through binding arbitration rather than court, except:

Small claims court actions
Intellectual property disputes
Actions to stop unauthorized use

Class Action Waiver

Disputes resolved individually, not as class actions or consolidated proceedings.

14. Changes to Terms

We may modify these Terms at any time. Changes effective when posted with updated "Last Updated" date.

Notice of Changes:

Material changes communicated via email
Continued use after changes constitutes acceptance
If you disagree, stop using Services and close account

15. General Provisions

Entire Agreement

These Terms, Privacy Policy, and any posted guidelines constitute entire agreement between you and WorksheetPal.

Severability

If any provision deemed invalid, remaining provisions remain in full effect.

No Waiver

Failure to enforce any right or provision does not constitute waiver of such right.

Assignment

You cannot assign or transfer these Terms. We may assign to successor or affiliate.

Force Majeure

Not liable for delays or failures due to circumstances beyond reasonable control (natural disasters, war, pandemics, infrastructure failures).

Survival

Provisions that by nature should survive termination will survive (intellectual property, liability limitations, dispute resolution).

Language

These Terms are written in English and may be translated into other languages for your convenience. If there is any conflict or inconsistency between the English version and a translated version, the English version controls.
